This bill would strengthen the Lacey Act by addressing certain unintended consequences of the 2008 Amendments

Fleming Amendment #001 – Increases Transparency on Lacey Act Provisions (Agreed to by Voice Vote.)
This amendment would establish an effective date; create a database on foreign laws; stipulate that the universe of foreign laws is limited to those directly involved in the conservation, management, and protection of plans; modify the declaration requirement to solid woods only; re-establish the “innocent owner” defense; and clarify that all products that are subject to civil forfeiture actions under the Act are no automatically deemed contraband.

Markey Amendment #001 – Prohibits Plant Importation from Certain Countries (Failed 19-24. View Roll Call Vote)
This amendment would prohibit the importation of plant or plant products from certain countries.

Garamendi Amendment #002 – (Failed 18-25. View Roll Call Vote)
This amendment would give the Secretary of the Interior and Governors of timber-producing states the authority to nullify the Act as amended.
