The Native Hawaiian Government Reorganization Act of 2009, also known as the Akaka bill, would create a separate governing entity for Native Hawaiians. Following strong opposition from Hawaii’s Governor and Attorney General, the Democrat Majority abandoned their efforts to adopt the proposed revisions but still passed the original bill out of Committee. Republicans continue to have fundamental constitutional concerns with this bill.

The night before the markup, Hawaii Attorney General Mark Bennett on behalf of Governor Linda Lingle sent a letter stating “strong opposition” to the latest version of H.R. 2314, which was unveiled only after the Committee suddenly announced its intention to markup and advance the altered text. Ranking Member Hastings motion to postpone the markup would allow interested parties 60 days to thoroughly review proposed changes to the bill.
